Terms of Service

1. Acceptance of Terms

By accessing or using CyTeach, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

CyTeach is an AI-powered tutoring platform that allows students to upload course materials and engage in structured tutoring sessions, generate study plans, create quizzes and flashcard decks, and track their preparation for exams. The Service is provided on an "as is" basis and is subject to change or discontinuation at any time.

3. Eligibility

• You must be at least 13 years old to use the Service.
• Users between 13 and 17 years old should have parental or guardian consent.
• The Service is currently available to users in the United States, United Kingdom, Canada, Australia, Ireland, New Zealand, and Singapore. We may restrict access in other regions.
• You may not use the Service if you have been previously banned or suspended by CyVante.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating your account and to keep it up to date.
• You must notify us immediately at admin@cyvante.com if you believe your account has been compromised.
• You may not share your account with others or transfer it to another person.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Upload or submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Use the Service to cheat on academic assignments, exams, or assessments in ways that violate your institution's academic integrity policies.
• Attempt to reverse-engineer, scrape, or otherwise extract data or AI model outputs from the Service for commercial purposes.
• Use automated scripts, bots, or other means to access or interact with the Service without authorisation.
• Circumvent or attempt to circumvent any access controls, subscription tiers, or usage limits.
• Upload content that infringes third-party intellectual property rights.

6. Your Content

You retain ownership of any notes, files, and materials you upload to the Service ("Your Content"). By uploading Your Content, you grant CyVante a limited, non-exclusive licence to process and use it solely to provide the Service to you. We do not use Your Content to train AI models or share it with third parties except as necessary to deliver the Service (for example, transmitting session messages to AI model providers to generate responses).

7. Subscriptions and Payment

• CyTeach offers both free and paid subscription plans. Paid features are described on the pricing page and are subject to change.
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service and authorise us to charge your payment method on a recurring basis.
• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• We reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.

8. Intellectual Property

All software, designs, text, and other content provided as part of the Service (excluding Your Content) are the intellectual property of CyVante or its licensors. You may not copy, modify, distribute, or create derivative works from the Service or its components without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE. AI-generated responses are not a substitute for professional academic, medical, legal, or other advice.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CYVANTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or for any other legitimate business reason, with or without notice. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — shall survive.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction in the United States, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be communicated via the Service or by email where reasonably practicable. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
